GENERAL TERMS AND CONDITIONS

1. Basic Information about the Service Provider

  • Tax Status: The business is not in the VAT system in accordance with the provisions of the VAT Act.

2. Nature of Service and System Purpose

  • Subject of service: These terms apply to the delivery, installation, and commissioning of network infrastructure, Smart Home systems, and IP cameras supplied by the Contractor.
  • Smart Home focus: The services provided by the Contractor are primarily aimed at smart home solutions, process automation, and improving living quality through IT and sensor infrastructure.
  • Exclusion of security purpose: The system is exclusively of an informative nature and has no protective (security) purpose. The Contractor does not provide services within the scope of the Private Protection Act, and the delivered network system cannot be considered an official technical security system for objects. The implemented solutions do not replace the services of certified security companies, emergency services, or professional anti-burglary alarm systems.

3. Scope of Work, Quality Guarantee, and Technical Limitations

  • Scope of work: The Contractor's work includes exclusively the hardware installation of the delivered equipment and network configuration (connection to the local network, internet access, and IP addressing of devices).
  • Functionality upon installation: The Contractor delivers the network equipment in technically working condition, guarantees its proper functioning at the time of installation, and the quality of the performed work. The Contractor is obliged to provide regular system maintenance only if defined by a separate agreement.
  • Limitation of sensor functionality: Due to potential sensor malfunctions and other technical factors beyond their control, the Contractor cannot guarantee the daily functionality of the system at all times.
  • Exclusion of liability for damages: Under no circumstances shall the Contractor be held liable for any material or non-material damage caused by system unresponsiveness, sensor failure, network outage, or any other technical defect.

4. Field Interventions and Client Obligations

  • Technical support: The Contractor acts as specialized technical support, not as a security service. Field visits serve to eliminate technical malfunctions, verify equipment functionality, or perform necessary remediation to minimize damage.
  • Third-party obligation: The Client is obliged to provide a primary responsible person (third party) for general property supervision. The Client agrees not to rely on the system as the sole means of notification and that the engaged third party will independently verify all system alerts.
  • Voluntary assistance: If the third party is unavailable, the Contractor offers the possibility of temporarily assuming the role of verifier, strictly on a voluntary basis and only if available at that moment, without assuming any legal or material liability for the security of the property.

5. Principle of Good Faith and Force Majeure

  • Contractor's conduct: All work and interventions are performed conscientiously and in good faith to protect the Client's interests. Physical interventions are limited to necessary remediation, while IT issues are resolved independently.
  • Limitation of field visits: The Contractor is not obliged to visit the location in case of force majeure, extreme weather conditions, or extraordinary life circumstances, and under no circumstances assumes the role of an absolute guarantor for property security.

6. System Handover and User Privileges

  • Transfer of administrator rights: By paying the invoice and taking over the equipment, the Client assumes all administrator access credentials. The Contractor has no insight, access, or control over the system, except when the Client explicitly requests technical support.
  • Independent management: The Client independently manages all system functions, which includes pointing cameras, defining detection zones, and managing and deleting archived recordings.

7. Client Obligations Regarding Video Surveillance (GDPR)

  • Personal use: The Client fully understands and accepts the obligation to use the delivered system in accordance with the General Data Protection Regulation (GDPR) and the laws of the Republic of Croatia. The system is intended solely for personal use and automation within the Client's private property.
  • Prohibition of recording public areas: The Client commits not to point cameras towards public areas (streets, squares) or capture other people's private property without explicit consent.
  • Exclusive Client liability: It is the exclusive responsibility of the Client if, through the use of this network equipment, they violate the constitutional right to privacy of third parties or breach the regulations of the Personal Data Protection Agency (AZOP).

8. Additional Services Outside the Smart Home Scope and Subcontractor Management

  • Scope of additional services: In addition to primary Smart Home services, the Contractor offers general property technical maintenance services. This includes, but is not limited to: IT system servicing and maintenance, pool equipment maintenance, coordination of white goods servicing, handyman services (minor repairs, lighting replacement, preventive maintenance), gardening and exterior maintenance (mowing, pressure washing), and coordination of professional property photography.
  • Property maintenance interventions: When the aforementioned tasks and interventions are performed directly by the Contractor, they are classified as standard interventions within the scope of regular technical property maintenance. The Contractor commits to performing the work professionally and conscientiously, in accordance with the rules of the profession.
  • Engagement of external subcontractors and Client approval: For specific, highly complex interventions or services requiring additional expertise (such as complex repairs of pool equipment or white goods, and professional photography), the Contractor reserves the right to engage verified external experts (subcontractors). Any potential engagement of third parties will be transparently communicated with the Client in advance, and work will not commence without their explicit approval.
  • Contractor's role and supervision: In the event of engaging subcontractors, the Contractor assumes the role of project organizer, communication coordinator, the person responsible for granting property access, and supervisor. The Contractor commits to monitoring the quality and progress of the work and promptly notifying the Client of the workflow, as well as any potential issues, deviations, or unforeseen situations on-site.
  • Subcontractor liability: Regardless of the organization and supervision by the Contractor, the exclusive legal, material, and warranty liability for the quality of execution, safety, and functionality of installed parts is borne independently by the subcontractor who performed the work. The Contractor (MG Servisi) assumes no liability for any omissions or direct damages caused by the actions of external contractors.

9. Privacy Protection and Web Analytics

  • Purpose of data collection: The Contractor uses Google Analytics on their websites exclusively for traffic analysis, content optimization, and improving the user experience.
  • Consent system (Cookies): The use of analytical technologies is strictly carried out with the Client's (visitor's) explicit consent via a consent management system. Without active consent, analytical scripts are not activated.
  • Anonymization and identity protection: All collected analytical data is anonymized (including IP address masking) and cannot be linked to the user's personal identity. Data is processed in accordance with applicable legal regulations (GDPR).
  • Right of withdrawal: The Client retains the right to withdraw consent and modify tracking settings at any time through the dedicated interface on the Contractor's website.

10. Coverage Area

The Contractor provides services across the entire island of Brač (Croatia). The coverage area includes all settlements on the island, including:

North coast

Sutivan, Mirca, Supetar, Splitska, Postira, Pučišća

Eastern part

Povlja, Selca, Sumartin

South and west side

Bol, Murvica, Milna, Bobovišća, Ložišća

Inland

Škrip, Nerežišća, Dol, Donji Humac, Gornji Humac, Pražnica

Services outside the specified area can be arranged individually upon request.

Legal Notice: These General Terms and Conditions form an integral part of the issued invoice for the delivered equipment and services. By paying the invoice, the Client (buyer) confirms that they have received the equipment in working condition and that they fully understand and accept the above terms of use and privacy rules.
